TAGLING — TERMS OF USE

Part A — About these Terms
1. About Tagling and this agreement
1.1 Tagling sells a physical pet ID tag (the Tag) and a related online subscription service (the Service). These two things are different:
- the Tag is a physical product you buy from us once; and
- the Service is an ongoing subscription that keeps your pet's online profile page (the Profile) active and editable, and that sends you alerts when your Tag is scanned.
1.2 These Terms of Use (the Terms) govern your purchase of the Tag and your use of the Service. By buying a Tag or using the Service, you agree to these Terms.
1.3 We sell the Tag and supply the Service to customers in Australia only. These Terms are written for Australian consumers.
1.4 A separate Privacy Policy explains how we handle personal information. The Privacy Policy forms part of your agreement with us.
2. Definitions
In these Terms:
- ACL means the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Account means the account you create to manage your Tag, Profile and Subscription.
- Finder means any member of the public who scans your Tag.
- ID Only Mode has the meaning given in clause 8.5.
- Privacy Mode means the Service feature described in clause 7.4.
- Profile means the web page that your Tag's QR code links to, showing the information you choose to publish.
- Scan means using a smartphone or other device to read the QR code on a Tag.
- Scan Alert means an SMS message we send you when your Tag is Scanned, as described in clause 5.
- Service means the subscription service described in clause 7, including the hosted Profile, Scan Alerts and Privacy Mode.
- Subscription means a paid (or free-period) plan that keeps the Service active for a Tag.
- Tag means the physical QR-code pet ID tag we supply.
- you / your means the person who buys a Tag or uses the Service. We assume you are the pet's owner or are authorised to act for the owner.
3. Acceptance and eligibility
3.1 You may only buy a Tag or use the Service if you:
- (a) are at least 18 years old;
- (b) have legal capacity to enter into a binding contract; and
- (c) are acquiring the Tag and Service for use in Australia.
3.2 By buying a Tag or using the Service, you confirm that you meet these requirements.
3.3 If you are using the Service on behalf of someone else (for example, a family member's pet), you confirm you are authorised to do so and to agree to these Terms for them.
Part B — How Tagling works
4. What Tagling is — and what it is not
Please read this section carefully. It describes what the Tag and Service can and cannot do.
4.1 The Tag is a passive QR code. It contains no GPS, no SIM, no battery, no cellular or radio transmitter, and no tracking hardware of any kind. The Tag does not, and cannot, track your pet's location. At no point does Tagling know where your pet is.
4.2 How location information arises. Location information only ever comes from a Finder's own device, and only when a Tag is Scanned. When a Finder Scans your Tag, the Profile page may ask the Finder's device for its current location. If — and only if — the Finder allows it and their device and network support it, we may send you a Scan Alert showing the approximate location of that Scan (that is, roughly where the Finder was standing when they Scanned the Tag). This is not your pet's location and is not continuous — between Scans there is no location information at all.
4.3 Tagling is a contact-facilitation tool, not a recovery service or a guarantee. The purpose of Tagling is to help a Finder contact you. We do not warrant, promise or guarantee that:
- (a) anyone will ever Scan your Tag;
- (b) a Finder will allow their device to share its location;
- (c) any location shown in a Scan Alert will be accurate, complete or timely;
- (d) any Scan Alert will be delivered to you, or delivered without delay (SMS delivery depends on mobile carriers and is outside our control);
- (e) a Finder will contact you, return your pet, or act honestly or safely; or
- (f) your pet will be found, recovered or returned.
4.4 Not an emergency or safety service. Tagling is not an emergency, security, or pet-safety service and must not be relied on as one. In an emergency, contact the relevant authorities.
4.5 The Tag supplements, and does not replace, your legal obligations. In New South Wales, owners of cats and dogs must microchip and register their animals under the Companion Animals Act 1998 (NSW), and other obligations may apply elsewhere. The Tag is an additional aid only. You remain responsible for complying with all laws that apply to keeping your pet, including microchipping and registration.
4.6 Nothing in this clause 4 limits the consumer guarantees described in clause 14.
Part C — The Tag (goods)
5. Buying and using the Tag
5.1 Price. The price of the Tag, and any shipping cost, is the price shown at checkout at the time you order. All prices are inclusive of GST.
5.2 What's included. When you buy a Tag, your first 12 months of Subscription is included at no extra charge (see clause 8). After that, the Subscription renews on a paid basis unless you cancel.
5.3 Delivery. We will dispatch your Tag to the address you give us. Please make sure your delivery address is correct. Estimated delivery times are estimates only. Risk in the Tag passes to you on delivery; title passes once you have paid in full.
5.4 Activation. To use the Service, you need to activate your Tag and set up your Profile through your Account. Until you do, the Tag works as a basic visual ID only.
5.5 Your responsibilities. You are responsible for securely attaching the Tag to your pet's collar and for checking from time to time that it is still attached and legible. Tags can be lost, damaged or worn through normal use; that is not a defect in itself.
5.6 Your rights if the Tag is faulty are set out in clause 14 (Australian Consumer Law).
6. Lifetime Replacement Guarantee
6.1 A voluntary guarantee, on top of your legal rights. In addition to your rights under the ACL (clause 14), we offer a voluntary Lifetime Replacement Guarantee on the Tag. This is a goodwill program. It does not replace, limit or affect your ACL rights, which always apply. In particular, if a Tag is faulty or not of acceptable quality, you have the remedies in clause 14 regardless of this guarantee, and at no cost to you where the ACL provides for that (including the reasonable cost of returning the Tag). The mandatory consumer guarantee statement in clause 14.2 applies to this guarantee.
6.2 What "lifetime" means. "Lifetime" means for the working life of the Tag, for the original purchaser, while you hold an active Tagling Account and an active Subscription. It does not mean the lifetime of you or your pet. We may change or end this guarantee for future purchases, but a change will not reduce a guarantee that already applies to a Tag you have already bought, except as the law allows.
6.3 What is covered. Subject to the conditions and exclusions below, we will replace a Tag that becomes damaged, worn, or no longer scannable through ordinary, fair use in reasonable conditions for a pet of your kind.
6.4 Who pays shipping.
- (a) If the Tag is faulty or not of acceptable quality, we cover the cost of the replacement, including return postage and reshipping, consistent with clause 14.
- (b) For any other replacement under this guarantee (for example, ordinary wear or accidental damage from fair use), we provide the replacement Tag at no charge, but you pay the shipping cost for the replacement.
6.5 Fair use and reasonable conditions. This guarantee assumes the Tag is used as a pet ID tag attached to a collar in everyday conditions. It does not cover damage or loss caused by:
- (a) deliberate damage, misuse, or abnormal use;
- (b) alteration, engraving, repair or tampering by anyone other than us;
- (c) use in conditions well beyond ordinary pet use (for example, deliberate exposure to extreme heat, chemicals, machinery or industrial environments);
- (d) cosmetic wear that does not stop the Tag working; or
- (e) loss or theft — which we are not required to cover, but may choose to replace.
6.6 How to claim. To make a claim under this guarantee:
- (a) you must be the original purchaser and hold an active Tagling Account and Subscription;
- (b) we may ask you for proof of purchase, photos of the Tag, and/or the return of the original Tag; and
- (c) we provide one replacement per approved claim. We may decline repeated or excessive claims that indicate misuse or abuse of the guarantee.
6.7 Replacement product. We will replace the Tag with the same or a functionally similar model. If the model is no longer available, we may supply a comparable Tag. The replacement Tag is covered by these Terms, including this guarantee.
6.8 How we assess claims. Except where the ACL or another law requires otherwise, we assess and decide claims under this voluntary guarantee acting reasonably and in line with the conditions and exclusions in this clause 6. This does not apply to, and does not limit, your ACL rights, which are not subject to our assessment.
Part D — The Service (subscription)
7. What the Service includes
7.1 While your Subscription is active, the Service gives you:
- (a) a hosted, editable Profile that your Tag links to, showing the information you choose to publish;
- (b) Scan Alerts by SMS when your Tag is Scanned, including approximate Scan location where available (see clause 4.2); and
- (c) Privacy Mode (clause 7.4).
7.2 The Service is required to keep these features active. If you do not have an active Subscription, your Profile reverts to ID Only Mode (clause 8.5).
7.3 The Profile is public by design. Anything you publish on your active Profile can be seen by anyone who Scans your Tag (subject to Privacy Mode). Do not publish information you are not willing to make public. Clause 11 sets out your responsibilities for Profile content.
7.4 Privacy Mode. Privacy Mode lets you control how your details are shown to a Finder. You can choose to:
- (a) hide your whole Profile; or
- (b) mask selected fields so they are not shown.
In all cases, a Finder must take an extra step (for example, confirming or requesting access) before any details you have chosen to share are revealed.
8. Subscription, billing, renewal and cancellation
8.1 Plan and price. The Subscription is an annual plan. The applicable fee is the fee shown at checkout or on our website at the relevant time. All fees are inclusive of GST.
8.2 Your free first year. When you buy a Tag, your first 12 months of Subscription are free. At the time of purchase, we (through our payment processor) securely store your payment details so that the Subscription can renew automatically when the free period ends.
8.3 Automatic renewal — please read. Unless you cancel beforehand:
- (a) your Subscription will automatically renew about 12 months after activation, and each year after that; and
- (b) we will charge the then-current annual fee to your stored payment method on each renewal date.
By buying a Tag and using the Service, you authorise us and our payment processor to charge your stored payment method for each renewal at the then-current fee until you cancel. You can cancel at any time before a renewal date (clause 8.7). We may send you a reminder before a renewal, but we are not required to do so, and any reminder we send does not change your responsibility to cancel before the renewal date if you do not wish to renew.
8.4 Price changes. We may change the Subscription fee from time to time. Any new fee applies only from your next renewal, not the period you have already paid for. We will give you advance notice by email before a changed fee first applies to you. If you do not accept the new fee, you can cancel before it takes effect (clause 8.7) and you will not be charged the new amount.
8.5 What happens if you do not have an active Subscription (ID Only Mode). If your free period ends without renewal, your Subscription lapses, a renewal payment fails after we have followed up, or you cancel, your Profile reverts to ID Only Mode. In ID Only Mode:
- (a) your Profile shows only your pet's name and a single contact phone number;
- (b) Scan Alerts are turned off — you will not be notified when your Tag is Scanned;
- (c) Privacy Mode and other Service features are not available; and
- (d) you cannot edit the Profile until you reactivate a Subscription.
The Tag itself remains yours and keeps working as a basic visual/contact ID.
8.6 Failed payments. If a renewal payment fails, we will let you know and may try again. If payment still fails after a reasonable period, your Profile moves to ID Only Mode until payment succeeds. We will not charge you again without your authority.
8.7 Cancelling. You can cancel your Subscription at any time through your Account or by emailing support@mytagling.com. If you cancel:
- (a) during a paid period, you keep full Service features until the end of the period you have already paid for, then move to ID Only Mode; and
- (b) during your free first year, you keep full Service features until the 12 months end, then move to ID Only Mode (unless you reactivate).
8.8 Refunds (in addition to your ACL rights). Your rights under the ACL (clause 14) always apply and are not affected by this clause. On top of those rights, we offer a generous change-of-mind policy:
- (a) Tag: you may return an unused, unactivated Tag within 30 days of delivery (or any longer period set out in our Refund Policy) for a refund of the price you paid for it; and
- (b) Subscription renewals: if you are charged for an annual renewal and you cancel within 30 days of that charge (or any longer period set out in our Refund Policy), we will refund that renewal in full.
The current details of our change-of-mind policy are set out in our Refund Policy on our website. There is no general statutory cooling-off period for online purchases in Australia, so this change-of-mind policy is something we offer voluntarily. If we ever shorten it, the change will not apply to a purchase you have already made.
8.9 Payment processing. We use third-party payment processors (currently Shopify Payments and/or Stripe) to process payments and to securely store your payment details for renewals. We do not store your full card details ourselves. By making a payment, you authorise us and our payment processor to charge your chosen payment method for the Tag and for each Subscription renewal at the then-current fee, and you confirm that you are entitled to use that payment method. Your payment may also be subject to the payment processor's own terms.
Part E — Content, data, privacy and conduct
9. Your content on the Profile
9.1 You control and are responsible for your Profile content. You decide what to publish on your Profile (for example, your pet's name, your phone number, vet details). You are responsible for ensuring that everything you publish is accurate, current, and lawful.
9.2 Third-party information. If you publish information about another person or business (for example, a vet's contact details or another person's phone number), you confirm you are entitled to publish it and, where required, have that person's consent.
9.3 Licence to us. So that we can run the Service, you grant us a non-exclusive, royalty-free licence to host, store, display and transmit your Profile content for the purpose of providing the Service (including displaying it to Finders who Scan your Tag). This licence ends when your content is removed, except for backups kept for a reasonable period or as required by law.
9.4 Our right to remove content. We may remove or disable Profile content that we reasonably believe is unlawful, infringes someone's rights, or breaches these Terms. Where practical and lawful, we will tell you and explain why.
10. Privacy
10.1 How we handle personal information is set out in our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
10.2 Public by design. As explained in clause 7.3, information on your active Profile is publicly accessible to anyone who Scans your Tag (subject to Privacy Mode). This is how the Service works.
10.3 Finder information. When a Tag is Scanned, we may collect information from the Finder's device, such as approximate location (where the Finder allows it), to provide Scan Alerts. Our Privacy Policy explains this in more detail.
11. Acceptable use
11.1 You must not, and must not allow anyone else to:
- (a) create false, misleading or fraudulent Profiles or pet information;
- (b) access or try to access another person's Account or personal information without permission;
- (c) scrape, harvest, copy or collect data from the Service or from Profiles using automated tools (such as bots or scrapers) or otherwise without our consent;
- (d) use the Service or any information for any unlawful purpose, including fraud, harassment, stalking or spam;
- (e) interfere with, disrupt, or try to bypass the security or proper operation of the Service; or
- (f) upload or transmit malware or any harmful code.
11.2 Finders. If you Scan someone else's Tag, you may use the owner's contact details only to help reunite the pet with its owner. You must not use, store, share or sell those details for any other purpose.
12. Service availability and changes
12.1 We aim to keep the Service available, but we do not promise it will be available without interruption. The Service may be unavailable during maintenance, updates, or for reasons outside our control (including SMS carrier issues, internet outages or third-party failures).
12.2 We may change, add or remove Service features over time. If a change is material and reduces the Service in a way that affects you, we will give you reasonable notice by email where we can.
12.3 This clause does not limit the consumer guarantees in clause 14 (including that the Service be supplied with due care and skill).
13. Intellectual property
13.1 We (or our licensors) own all intellectual property in the Tagling brand, the Service, the website, the software, and our content. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your own personal, non-commercial purposes in accordance with these Terms.
13.2 You keep ownership of the content you publish on your Profile, subject to the licence you grant us in clause 9.3.
13.3 You must not use our trade marks, logos or branding without our prior written consent.
Part F — Consumer rights, liability and termination
14. Australian Consumer Law and your rights
14.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded. If any part of these Terms would do so, that part does not apply to you to that extent.
14.2 Goods (the Tag):
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
14.3 Services (the Subscription):
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
15. Our liability to you
15.1 This clause is subject to clause 14. Nothing in it limits any right or remedy you have under the ACL that cannot be excluded.
15.2 The agreed basis of supply. You acknowledge that the matters in clause 4 (no tracking; no guarantee of Scans, contact, location accuracy, SMS delivery or recovery) are central to how Tagling works and form part of the agreed basis on which the Tag and Service are supplied. To the maximum extent permitted by law, we are not liable for loss or damage arising from those matters.
15.3 Indirect and consequential loss. To the maximum extent permitted by law, and subject to clause 14, we are not liable for any indirect, special or consequential loss, or for loss of profit, opportunity or goodwill, arising from the Tag or the Service.
15.4 Where liability can be limited. To the extent the law allows us to limit our liability for failing to comply with a consumer guarantee (for example, where goods or services are not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to: for goods — replacing or repairing them, or paying the cost of doing so; and for services — re-supplying them or paying the cost of re-supply.
15.5 Liability cap. Otherwise, and to the maximum extent permitted by law and subject to clause 14, our total liability to you in connection with the Tag and the Service is limited to the total amount you have paid us in the 12 months before the event giving rise to the claim.
16. Indemnity
16.1 To the extent permitted by law, you are responsible for, and agree to reimburse us for, loss we reasonably suffer from a third-party claim, to the extent the claim arises from:
- (a) content you publish on your Profile that is unlawful or infringes another person's rights; or
- (b) your breach of these Terms or your misuse of the Service.
16.2 This clause does not apply to the extent the loss was caused or contributed to by us, and does not require you to pay any amount that would be unfair or unenforceable under the unfair contract terms provisions of the ACL.
17. Suspension and termination
17.1 You may stop using the Service and cancel at any time (clause 8.7).
17.2 We may suspend or terminate your access to the Service, or remove content, if you materially breach these Terms, if required by law, or to protect the Service or other users. Where practical and lawful, we will give you notice and an opportunity to fix the problem first.
17.3 On termination, your Profile moves to ID Only Mode or is deactivated. Clauses that by their nature should survive (including clauses 9.3, 13, 14, 15, 16 and 18) continue to apply.
Part G — General
18. Governing law, changes and other terms
18.1 Governing law and jurisdiction. These Terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales. This does not limit any right you have under the ACL to bring proceedings elsewhere.
18.2 Changes to these Terms. We may update these Terms from time to time. If a change materially affects your rights, we will give you reasonable notice by email before it takes effect, and you may cancel before then if you do not accept the change. Otherwise, the current version is always available on our website, and continued use after a change takes effect means you accept it.
18.3 Severability. If any part of these Terms is unenforceable, it is severed and the rest continues to apply.
18.4 Entire agreement. These Terms, the Privacy Policy, the Refund Policy and any terms shown at checkout make up the whole agreement between you and us about the Tag and the Service, and replace any earlier understandings.
18.5 No waiver. If we do not enforce a right straight away, we do not give it up.
18.6 Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer, assign or novate ours — for example, if we sell or restructure our business — provided your rights under these Terms and the ACL are not materially affected. You do not need to do anything for a transfer by us to take effect. We may disclose information about you and your agreement with us to anyone involved in an actual or proposed transfer of our business or rights, in accordance with our Privacy Policy.
18.7 Things outside our control. To the extent permitted by law, we are not liable for delay or failure caused by events beyond our reasonable control. This does not limit your rights under clause 14.
18.8 Electronic communications. You agree we may communicate with you electronically (for example, by email to your Account address), and that those communications meet any legal requirement to be in writing.
18.9 Notices. We may give you a notice under these Terms by email to the address linked to your Account, by a message in your Account, or by post to the most recent address you have given us. A notice sent by email or shown in your Account is taken to be received when sent; a posted notice is taken to be received on the second business day after posting. Please keep your contact details up to date, as we rely on them. To give us a notice, email support@mytagling.com or write to the address in clause 19. This clause deals with notices under these Terms only and does not limit any method of serving legal documents that is permitted or required by law.
